Employer Questions Medical Records? ADA Rights & Exceptions
The Americans With Disabilities Act (ADA) prohibits employers from asking employees or applicants about their medical history or conditions if the inquiry is not job-related or a business necessity. However, there are some exceptions to this rule, such as:
- If the employer is required to collect medical information under another law, such as the Family and Medical Leave Act (FMLA).
- If the information is needed for safety reasons, such as in the case of hazardous jobs.
- If the employer is providing health insurance and needs the information to determine coverage.
