Assisted Living Resident Rights: Your Legal Protections

Residents of assisted-living facilities are entitled to certain rights. These rights include the basic right to a clean, safe living environment, as well as additional rights and privileges under the law.

Right To Privacy

• Assisted-living residents have the right to personal privacy. This includes, but is not limited to, the right to have visitors, the right to private telephone calls and the right to personal privacy. Privacy rights may vary by facility and by the individual needs of the patient.

Information Access

• Patients are allowed full access to their health care and admission records, and are allowed to participate in care-planning meetings or allow an authorized representative to participate on their behalf. Patients also have the right to refuse or authorize any proposed medical treatment.

Full Fee Disclosure

• Patients are entitled to a full fee disclosure, including all applicable charges for meals and daily care. Patients also have the right to be informed of any late charges for delinquent payments.
