LPNs: Avoiding Unfair Labor Practices & Ensuring Employee Rights
1. Interfering with union activity: LPNs should not interfere with the rights of employees to form and join unions, or to engage in union activities. This includes:
- Threatening or coercing employees to join or not join a union
- Discriminating against employees for their union membership or activity
- Refusing to bargain in good faith with a union
2. Discriminating against employees: LPNs should not discriminate against employees on the basis of race, color, religion, sex, national origin, age, disability, or other protected characteristic. This includes:
- Refusing to hire someone because of their protected characteristic
- Firing someone because of their protected characteristic
- Harassing someone because of their protected characteristic
3. Spying on employees: LPNs should not spy on employees or engage in other surveillance activities that are designed to intimidate or harass employees. This includes:
- Monitoring employee conversations or emails
- Following employees around
- Using hidden cameras or recording devices to record employee activity
4. Retaliating against employees: LPNs should not retaliate against employees who exercise their legal rights, such as the right to complain about unfair labor practices or to file a lawsuit against an employer. This includes:
- Firing employees for complaining about unfair labor practices
- Demoting employees for filing a lawsuit
- Refusing to promote employees who have exercised their legal rights
